Gas Blend Pro performs calculations for breathing gas mixtures used in technical diving. Incorrect gas mixtures can result in serious injury or death. By using this app, you accept full responsibility for verifying all calculations and ensuring the safety of your gas blends.

1. Acceptance of Terms

By downloading, installing, or using Gas Blend Pro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Gas Blend Pro is a calculation tool designed to assist with gas blending for technical diving using the partial pressure method. The App provides:

Gas blending calculations (Nitrox, Trimix)
Storage tank inventory management
Gas preset management
Calculation result displays

3. User Responsibility & Disclaimer

YOU ARE SOLELY RESPONSIBLE FOR:

Verifying all calculations manually before blending any gas mixture
Following proper diving safety procedures and industry standards
Ensuring compliance with local laws and regulations regarding gas blending
Maintaining proper certification and training for technical diving and gas blending
Using appropriate equipment and following manufacturer guidelines
Analyzing all gas mixtures before use

CRITICAL SAFETY NOTICE: This app is a calculation aid only. It does not replace proper training, certification, equipment, or gas analysis. Never dive with a gas mixture that has not been properly analyzed by calibrated equipment.

4. No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Accuracy or reliability of calculations
Fitness for a particular purpose
Merchantability
Non-infringement
Uninterrupted or error-free operation

We do not warrant that the App will meet your requirements or that any errors will be corrected.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Werk4 Services, its developers, affiliates, and licensors SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Use or inability to use the App
Incorrect calculations or results
Errors, bugs, or defects in the App
Loss of data or settings
Personal injury or death
Property damage
Any other damages whatsoever

This limitation applies even if we have been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless Werk4 Services, its developers, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another person or entity
Any gas blending activities you undertake

7. Age Restriction

The App is intended for use by certified divers and gas blenders only. You must be at least 18 years old and possess appropriate certifications to use this App. By using the App, you represent that you meet these requirements.

8. Modifications to Service

We reserve the right to:

Modify or discontinue the App at any time without notice
Update these Terms at any time
Change features, functionality, or content

Your continued use of the App after changes constitutes acceptance of the modified Terms.

9. Intellectual Property

The App and its content, features, and functionality are owned by Werk4 Services and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

Reverse engineer or decompile the App
Modify, adapt, or create derivative works
Remove copyright or proprietary notices
Use the App for commercial purposes without permission

Content or privacy practices of third-party sites
Availability of external resources
Any damages arising from use of third-party services

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Germany.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Werk4 Services regarding the App and supersede all prior agreements and understandings.

14. Termination

These Terms remain in effect until terminated by either party. We may terminate or suspend your access to the App at any time without notice. You may terminate by uninstalling the App.

15. Acknowledgment

BY USING GAS BLEND PRO, YOU ACKNOWLEDGE THAT:

You have read and understood these Terms
You accept all risks associated with gas blending
You will verify all calculations independently
You have proper training and certification
You understand that gas blending is dangerous if done improperly
